Pursuing Compensation for Infant Broken Bones Cases

When it comes to the birth of their child, expectant parents often plan extensively. Though no matter how well-prepared new parents are, unexpected events can still occur around childbirth. Babies being born with a broken bone is an event likely unforeseen by many parents, but broken bones are one of the most prevalent birth injuries.

If a baby is delivered with a broken bone, the parents may be able to pursue compensation if the harm was caused by carelessness or negligence. An experienced birth injury lawyer may be able to assist you in pursuing financial compensation through a medical malpractice lawsuit.

From your lawsuit, you may be eligible to pursue damages that include:

  • Medical treatment
  • Hospital stays
  • Physical Therapy
  • Pain and suffering

When pursuing compensation for an infant broken bone case, an experienced birth injury lawyer is invaluable. They can assess your case and guide you through the legal process to ensure that you receive a fair payment for your child’s medical treatment, suffering, and any other losses you’ve endured because of your baby’s injury.

Common Infant Broken Bone Injuries During Childbirth

Broken bones and fractures may result naturally during a difficult delivery. An emergency procedure to save the mother’s or the infant’s life could also result in broken bones.

However, many of the broken bones during labor and delivery result from poor medical treatment, inadequate preparation for delivery, or misdiagnosis of a condition. Sadly, medical negligence can result in an infant being born with broken bones.

Newborns have more bones than adults. As they grow, some bones fuse together. At birth, the infant’s bones are more fragile and softer than an adult’s bones. Therefore, the bones can break during delivery.

Clavicle fractures (collarbones) are the most common bones broken during childbirth. The humerus (long bone in the upper arm) and femur are other common newborn bone fractures. Other bones that might break during labor and delivery include those in the skull, leg, arm, and cervical spine.

What Are the Symptoms of an Infant Broken Bone Injury?

Symptoms that could indicate your child sustained broken bones during childbirth include:

  • Inability to move a body part
  • Swelling
  • Pain (indicated by constant and inconsolable crying)
  • Deformities

The physician may order an x-ray or other imaging test to verify the broken bone. The treatment options vary depending on the bone that is broken and the severity of the injury.

The injury may need to be immobilized to prevent further injury and permanent impairments. A bone may also need to be set so that it can heal properly. In severe cases, surgery may be required to repair the fracture.

If an infant’s bone injury is not treated promptly and correctly, a child could have permanent paralysis, nerve damage, and other complications. A child could also require ongoing occupational therapy or physical therapy to recover from the birth injury.

Who is to Blame for Infant Broken Bone Injuries During Childbirth?

As discussed above, there could be reasons for infant fractures that are beyond anyone’s control.

Causes of broken bones related to medical malpractice include:

  • Aggressive or improper use of forceps or vacuums during delivery
  • Pulling too hard or “yanking” the baby from the birth canal
  • Prolonged labor or rushed labor
  • Infants that are “stuck” behind the mother’s pubic bone (shoulder dystocia)
  • Failing to recognize a breech birth and provide the correct treatment
  • Unusually large baby and/or unusually small bone structure or the mother (pelvic bone)

The priority after birth is an immediate medical treatment for your infant. However, when your infant is stable, you may want to consider speaking with a Boston infant broken bone injury attorney.

Your child might require continued care and treatment. Additionally, your baby may sustain permanent disabilities because of a broken bone or brachial plexus injury. A birth injury lawyer can help you seek compensation for these costs and other damages from the parties responsible for your baby’s pain and suffering.
